Welcome to nickelsilverpress.com (the "Site"). The Site is operated by Nickel Silver
Publishing LLC, a Texas limited liability company ("Nickel Silver," "we," "our," or "us"),
which publishes under two imprints: Nickel Silver Press (fiction and merchandise)
and Nickel Silver Humanities Press (non-fiction, histories, memoirs, maps, and archival
material). These Terms apply to the entire Site and to both imprints.
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not
use the Site.
1. Intellectual Property
All content on the Site, including text, book excerpts, manuscripts, archival transcriptions
and introductions, maps, graphics, logos, crest, images, and design, is owned by Nickel
Silver Publishing LLC, its authors, or its licensors, and is protected by copyright, trademark,
and other laws. "Nickel Silver Press," "Nickel Silver Humanities Press," our crest, and our
series titles are used as trademarks of Nickel Silver Publishing LLC, whether or not
registered. We reserve all rights in them.
You may view the Site and share links to it for personal, non-commercial use. You may not
copy, reproduce, distribute, scrape, or create derivative works from any content without our
prior written permission. Excerpts may be quoted for review or commentary to the extent
allowed by fair use, with credit to the author and a link to the Site.

3. Pre-Orders and Direct Sales
Books and other products purchased through the Site are sold by Nickel Silver Publishing LLC.
Payments are processed by Stripe.
Pre-orders.
A pre-order is a purchase of a product that has not yet been released, including limited
or special editions (for example, a Founders Edition).
Your payment method is charged [at the time of order / at shipment; choose one].
The estimated ship date shown on the product page is [Insert Date or Window]. It is an
estimate. If we expect a delay of more than [30] days, we will notify you by email and
offer you the choice to keep your order or cancel for a full refund.
You may cancel a pre-order for a full refund at any time before it ships by emailing
info@nickelsilverpress.com.
Pre-order revenue helps fund production of the book, but a pre-order is a purchase, not
an investment, and gives you no ownership interest in Nickel Silver.

Prices, edition details, and availability may change without notice, but the price you pay
is the price shown when you place your order.
We may refuse or cancel an order (for example, due to a pricing error, suspected fraud,
or stock issues). If we cancel, we will refund you in full.
Shipping methods and costs are shown at checkout. Risk of loss passes to you on
delivery to the carrier's stated address.
Returns and refunds: Physical books that arrive damaged
or defective will be replaced or refunded if you contact us within 30 days of delivery.
Otherwise, sales are final. You are responsible for any applicable sales tax, duties, or import fees.
4. Archives and Historical Material
The Humanities Archives section presents family, historical, and archival material for
research and reading. It is not currently a sales section.
Content reflects the research, records, and recollections of the authors and
contributors. We work for accuracy but do not guarantee it, and historical or family
accounts may be incomplete or disputed. Memoirs and personal histories are individuals'
recollections, not verified statements of fact.
If you are a descendant, family member, or rights holder and believe material on the Site
is inaccurate, private, or used without proper permission, contact us at
info@nickelsilverpress.com. We will review your request promptly and, where appropriate,
correct or remove the material.
Fiction published by Nickel Silver Press is a work of fiction. Characters and events are
products of the author's imagination unless clearly presented as historical.
5. Website Use and Prohibited Conduct
You agree to use the Site only for lawful purposes. You may not:
interfere with or impair the Site's availability, security, or performance;
attempt to gain unauthorized access to any system, account, data, or network
connected to the Site; transmit spam, malware, or automated queries, or scrape the Site;
submit false information, including in questionnaires or order forms;
use the Site to infringe anyone's rights.
6. Communications You Request
If you complete a reader-preferences questionnaire, sign up for a mailing list, or place an
order, you agree we may email you about that request, including confirmations and updates.
Marketing emails are sent only if you opt in, and every marketing email includes an
unsubscribe link. See our Privacy Policy for details.
7. Third-Party Links and Services
The Site may link to or rely on third-party services, such as Stripe, our website host, and
email providers. We do not control and are not responsible for their content or practices.
Your use of them is governed by their own terms.
8. Disclaimers and Limitation of Liability
The Site and its content are provided "as is" and "as available," without warranties of any
kind, express or implied, to the fullest extent permitted by law. We do not warrant that the
Site will be uninterrupted or error-free.
To the fullest extent permitted by law, Nickel Silver Publishing LLC and its owner,
contributors, and service providers are not liable for indirect, incidental, special, or
consequential damages arising from your use of the Site. Our total liability for any claim
relating to a purchase will not exceed the amount you paid for that purchase. Nothing in
these Terms limits liability that cannot be limited by law, including any rights you have as a
consumer.
9. Changes to the Site and Terms
We may update the Site or these Terms at any time. Changes take effect when posted, with
a new "Last Updated" date. Orders are governed by the Terms in effect when you placed
them.
10. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-
law rules. Any dispute arising from them or your use of the Site will be brought in the state
or federal courts located in [Collin County], Texas, and you consent to their jurisdiction.
